Article 1 (Purpose)

These Terms govern the rights, obligations, and responsibilities between Smallgear (the "Company") and users in connection with the use of the webtm service provided through webtm.dev and related services (the "Service").

Article 2 (Effect and Amendment of the Terms)

These Terms take effect upon being posted on the Service screen. The Company may amend these Terms within the scope that does not violate applicable laws, and in the event of an amendment will announce it in advance within the Service, specifying the effective date and the reason for the change.

Article 3 (Provision of the Service)

The Company provides the webtm service. The Company may change the content of the Service it provides as required for operational or technical reasons, in which case it will announce such changes in advance.

Article 4 (Formation of the Use Contract)

A use contract is formed when a user agrees to these Terms, applies for use in accordance with the procedures established by the Company, and the Company accepts such application.

Article 5 (Fees and Payment)

The fees and payment conditions for paid services follow the Pricing page. Payments are processed through a payment provider designated by the Company (such as Paddle), and the user is deemed to also agree to the terms of the payment provider presented at the time of payment. Paddle acts as the Merchant of Record for the transaction; the Paddle Buyer Terms apply to the purchase, and Paddle handles billing and applicable taxes.

Article 5-2 (License and Scope of Use)

Upon a paid subscription, the Company grants the user a non-exclusive, non-transferable license to use the features of the applicable plan. The Service is provided on a self-hosted basis, installed and operated by the user in their own environment.

The license is granted on a per-user (per-subscriber) basis. The license holder may, for their own personal use, install and use the Service on an unlimited number of devices and instances.

However, where a person other than the license holder uses the Service, a separate subscription is required for each such user. That is, sharing a single installation among multiple users (team/organization sharing) or providing access to a third party requires that each user hold a subscription. The user must not share, transfer, or resell the license key to any third party.

Where a plan includes multi-user, team, or access-management features, those features are provided to administer multiple users who each hold their own subscription (on a per-seat basis); they do not grant the right to share a single subscription among multiple users.

The license is verified offline by technical means, and regardless of whether it is technically enforced, the user is obligated to comply with the scope of use under this Article. The Company may suspend the use of the relevant license or terminate the use contract where a violation of this Article (unauthorized use) is confirmed.

Article 6 (Withdrawal of Subscription and Refund)

Matters concerning the withdrawal of subscription and refunds for paid services follow the Refund Policy, in compliance with the Act on the Consumer Protection in Electronic Commerce, etc. and other applicable laws.

Article 7 (User Obligations)

The user must comply with applicable laws, the provisions of these Terms, the usage guidance, and matters announced on the Service, and must not engage in any act that interferes with the Company's operations.

Article 8 (Limitation of Liability)

The Company is not liable for any interruption of the Service caused by reasons beyond its control, such as force majeure or causes attributable to the user. To the extent permitted by applicable law, the Company's liability for damages may be limited.

Article 9 (Governing Law and Jurisdiction)

These Terms are governed by and construed in accordance with the laws of the Republic of Korea, and the court having jurisdiction under the Civil Procedure Act shall be the court of first instance for any dispute arising in connection with the use of the Service.

Article 11 (Language)

These Terms are provided in Korean and, for the user's convenience, in other languages. In the event of any conflict or inconsistency between the Korean version and a translated version, the Korean version shall prevail.
